The following are the terms and conditions for an individual or organization (hereafter referred to as the "Client) using websites owned and operated by the Education Group for advertising, promotional and/or informational purposes (herein after referred to as "Advertising"):
1: The Client agrees and hereby accepts rates as charged. All costs are subject to applicable taxes.
2: Advertising and related charges are non-transferrable and non-refundable.
3: Unless otherwise specified in writing, the positioning of any Advertising is at the sole discretion of the Education Group.
4: The Client agrees that the Education Group shall not be subject to any liability whatsoever for any errors or omissions in whole or in part for any cause whatsoever, beyond the refund of any fees paid by the Client.
5: The Client assumes complete liability for all statements contained in Advertising and assumes responsibility for any claims against the Education Group which in any way arise out of the publication of such Advertising and further agrees to save the Education Group harmless from any claim that may be brought against it and to reimburse the Education Group for any amount paid by it in settlement of any such claim or in satisfaction of a judgement obtained and to pay all reasonable expenses (including legal fees on a solicitor and client basis) incurred in connection therewith including the defense of any such claim.
6: No warranty is made nor is the Client relying on any representations by the Education Group or its agent as to circulation or expected circulation or any other matter relating to the effectiveness or expected effectiveness of Advertising.
7: The Client agrees that the Education Group shall not be subject to any liability whatsoever for any failure to publish or circulate any Advertising in whole or in part for any cause whatsoever, beyond the refund of any fees paid by the Client. Dates for the publication and release of any Advertising may change without notice.
8: At the sole discretion of the Education Group the word "advertisement" may be inserted above or below any Advertising without notice.
9: If the Education Group deems it advisable to retain the services of a solicitor to collect an overdue account, the Client shall be liable for the legal costs of the Guide on a solicitor and client basis.
10: The Education Group reserves the right to refuse to accept Advertising for any reason at any time solely at the discretion of the Education Group.
11: Articles, editorial material or witten content submitted to the Education Group for publication in print, electronic or other media may be used, reproduced, published, re-published, distributed, stored and archived in whole or in part in any form or medium whatsoever in perpetuity by the Education Group without compensation unless compensation is expressly offered and agreed upon in writing.
12: Articles, editorial material or written content published by the Education Group may be reproduced at any time with written permission from the publisher. Any reprints of material should include a notation "Reprinted with permission from EducationGroup.ca". Contact Us for reprint requests.
13: In addition to these Terms of Use, all Clients agree to, accept and are subject to the Education Group Privacy Policy.
